In the majority of European Union countries, women are far better represented in the European Parliament than in the lower house of their respective national parliaments. This article examines the political signicance of this imbalance through a case study of French women members of the European Parliament. The marginality of the European Parliament in French politics has meant that women have succeeded in getting elected there and that they have had access to power positions in the (...) European Parliament. Some of these women have occupied positions in traditionally male areas like economics and nance. The European Parliament has been for many women politicians a secondary point of entry into national electoral politics. In French politics, the European Parliament provides a forum for the partial overturning of nationally determined political values, especially those that determine the sexual division of political labour. The European Parliament also creates pressures for changes in the gender composition of other sectors in the French political field. (shrink)

This paper employs institutional theory as a theoretical lens and examines the role of status and peer influence on diversity following a change in European labour law in 1995. This change in European labour law, well-known as the Bosman ruling, significantly increased labour mobility in European soccer. The ruling lifted restrictions on the number of foreign players that soccer teams could recruit and eliminated compulsory transfer fees for players whose contracts had ended. We demonstrate (...) that the Bosman ruling, while increasing the number of foreign players on a team, did not uniformly affect all teams. Our investigation indicates that the increase in racio-ethnic diversity in teams depended on the status of teams and on peer influence (the behaviour of similar teams). This setting, though specific to European labour law in the context of soccer, allows an examination of the complex interplay between racio-ethnic diversity, status, and peer influence in a period of institutional change. The practice of early modern natural history depended on the collective collecting activities of a great variety of people. Among them, artisans played a major role in acquiring and distributing knowledge about the natural world and they contributed significantly to the scholarly labour in natural history. This distributed labour was both acknowledged by contemporaries as well as hidden from sight, reflecting the period′s dominant norms for class and gender. By combining an interpretation of the visual representation of (...) class='Hi'>labour in European insect studies with an examination of written sources about natural history practices from about 1680 to 1810, this article decodes the often‐codified frontispieces and other more symbolic illustrations to offer new insights into the labour of natural history. Those who identified as scholars and artisans (or both) conceptualised their own intellectual and practical engagement with natural history within the semantic field of work. Some seemed to have even envisioned a new social role for academics as well as artisans. This article analyses the diversity of the “productive forces” in insect studies as they changed over time and it reconstructs what I will call the social imaginaries of participation. (shrink)

The article deals with the impact of the recent jurisprudence of the European Court of Human Rights (ECHR) on the German labour law practice. After a brief introduction of the general importance of the jurisprudence of the ECHR for the German labour law (I.), the authors illustrate the German and the ECHR’s jurisprudence on the duty of loyalty towards the ecclesiastic employer (II.) and whistle blowing (III.). Analysing this jurisprudence, the authors come to the conclusion that the (...) ECHR approved the principles of the German jurisprudence in these cases. Therefore, its impact on the practice will be rather marginal as it does not obtain such a far-reaching significance that a change in the jurisprudence regarding dismissals is to be expected. The judgements merely raised the awareness for the set of problems in the context of ecclesiastic employers and whistle blowing. In this regard, the article will try to provide the reader with basic directions on how to deal with this jurisprudence. Finally, the authors argue that concerns, the ECHR could evolve into a further instance reviewing all German judgements not only regarding the question if there is a violation of the Convention or not but regarding the correctness of the findings are unfounded. On the other side, the article addresses the problem that – apparently – applications have been declared admissible by the ECHR despite Art. 35 para. 1 of the European Convention on Human Rights because the final decision on the national level – dismissing the complaint as inadmissible – did not reveal the reason why the application did not succeed. 'The evaluation and ranking of our universities and their departments is here to stay. Should we oppose them, denounce them, sabotage them as much as we can? Or can and should we use them, refashion them, expand them, in such a way that our universities end up fulfilling their various functions better than before, without worsening our lives or those of our students in the process?' These were the questions put to the keynote speakers and over one hundred participants at (...) the 7th Ethical Forum of the University Foundation. As usual, the speakers presented contrasting viewpoints and the discussion was lively. This article explores the tension between competing discourses within the European Union, as this regional trading bloc seeks to capture further gains from market integration, whilst simultaneously attempting to soften the social impact of regional competition within its borders. This article analyzes the difficulty of maintaining the European social model, or a revised version of it, in the context of increased market integration. Through a close reading of two cases decided by the European Court of Justice in (...) 2007, the article interrogates the extent to which discourses on social rights at the EU level can be made sufficiently robust to ensure the application of international or national labor standards as a buttress against increasingly mobile capital, in order to prevent “social dumping." It concludes, however, that the terms on which the foundational texts of the EU integration project operate—elevating “market" rights to equal, fundamental, status with social and labor rights—means that the exercise of social rights such as the right to strike is ultimately contingent on their compatibility with market integration. Starting from the dispute centered around « positivity of politics » and « negativity of theory », as it took place on the mailing list of the NextGENDERation — a European network of students and researchers in women’s studies - we investigate the ways in which the split between « thinking » and « doing » is among the key mechanisms that demarcate the knowledge production along the lines of race and gender. As generations of feminists have pointed out, (...) the dismissal of the knowledges of « Others » - women and ethnic peoples as theory, and the relegation of these knowledges to the category of « description », maintain a sexual and racial division of labour in favour of white intellectuals, and ultimately preserves the existing social relations of domination. We argue that the affirmation of feminist practices, and perhaps its re-politicization cannot afford to pass through the negation of theory. Instead, we urge, in the light of NextGENDERation’s feminist intervention at the European Social Forum in Florence, for a recuperation of feminist, antiracist and queer genealogies which would allow for new forms of feminist subjectivities on the one hand, and the furthering of feminisms as oppositional projects on the other. The paper presents a partial evaluation of employment and factors related to the labour markets in European countries in 2007-2016. The interconnectedness of these determinants in the context of GDP dynamics per capita for each country was examined. The quoted partial subject literature and empirical research allowed to formulate the most important conclusions, among others: in the context of GDP dynamics per capita, at least four groups of countries can be distinguished in Europe, each of them has completely (...) different characteristics having an influence (in the Granger causality sense) on change in GDP per capita of these countries for various time steps. It has become obvious that the European response to the Japanese challenge cannot be limited to copying the lean production model. Transformation processes within successful enterprises depend on the employees' consensus. Therefore, such transformation processes have to improve both competitivity and the quality of work. In this context trade unions can play an important role but they are in need of new competences. This means that cooperation between trade unions and research centres becomes of utmost importance. The emergence of the European Union citizenship agenda has mainly taken place along the evolution of mobility rights, with the goal of creating a pan-European labor market. Mobility undermines the nationally embedded notion of industrial citizenship. Industrial citizenship protects workers’ rights and secures their participation in national political systems. The Europeanization of labor markets severs the relationship between state, territory and citizen on which industrial citizenship has been built, undermining worker collectivism and access to representation. This is legitimated (...) in terms of building market-citizenship, i.e., enabling mobile workers as market actors. However, the way mobility is regulated in the EU has the purpose and effect of weakening collective labor institutions, which also undermines workers’ ability to act as autonomous market actors. The same factors which undermine the industrial citizenship of mobile workers also prevent them from being effective free market agents: i.e., they can neither negotiate nor enforce individual contracts effectively in the face of systematic employer fraud and wage theft. The “Arendtian dilemma” of the “right to have rights” — a dilemma that derives from the claim that rights depend on the existence of a political community, which until now is the territorially exclusive nation-state, rather than universal personhood — emerges as industrial citizenship is internationalized. By disembeddeding workers from host-country industrial relations systems, EU regulation provides the social context in which workers’ rights become alienable. (shrink)

Temporary labor migration constitutes a significant trend of migration movements within the European Union, especially after the 2004 and 2007 EU enlargements. However, compared to other forms of TLM, intra-EU TLM has received scant attention from normative theorists. By drawing on Iris Marion Young's conception of structural injustice, this article analyzes the injustice of TLM within the EU. It argues that purely rights-based approaches are deficient and that a structural injustice approach is needed. The latter sheds light on the (...) formal and informal processes that place EU temporary migrants in a condition of vulnerability and reveals the multiple individual and collective agents participating in such processes. Moreover, such an approach offers important insights into the agency of migrants by showing how they themselves reinforce structural processes that put not only individual temporary migrants but also similarly positioned migrants and other members of the sending and receiving countries in a vulnerable position. A structural injustice approach does not deny that intra-EU temporary labor migrants should enjoy the rights and entitlements that they currently have in the host country as European citizens. Nor does it dispute that reducing the vulnerability of temporary migrants may require “special rights” accommodating the specific nature of their life plans. Instead, though such rights may be necessary, a structural injustice approach demonstrates how they are insufficient to tackle the injustice of intra-EU TLM and other forms of temporary labor migration more broadly. We have no interest whatever in minimizing the continuing history of racist, sexist, homophobic, or otherwise abusive biologisms, or the urgency of their exposure, that has made the gravamen of so many contemporary projects of critique. At the same time, we fear — with installation of an automatic antibiologism as the unshifting tenet of `theory' — the loss of conceptual access to an entire thought-realm. I was left wondering what danger had been averted by the exclusion of biology. What does (...) the nominative `biological or anatomical body' actually refer to? And what secures the separation of its inadmissible matter from the proper purview of Irigaray's textual interventions? When I asked a question to this effect it was met with a certain nervous comprehension. Deciding, perhaps, that I must still be immersed in a precritical understanding of the body, the speaker dismissed me with a revealing theatrical gesture. As if to emphasize the sheer absurdity of my question she pinched herself and commented `Well I don't mean this body'. And so it seemed with a gesture so matter of fact that it required no further comment, the fact of matter was both decided and dispatched. Feminism has been as deeply implicated in routinized antiessentialism as any of our critical procedures. Even though questions of `the body' have become increasingly fashionable in all manner of feminist projects, the schedule of feminism's antibiologism has been little altered. In most of these projects on `the body', the body in question is pursued in its socially, experientially, or psychically constituted forms, but rarely in its physiologically, biochemically, or microbiologically constituted form, the idea of biological construction having been rendered either unintelligible or naive. Despite an avowed interest in the body, there is a persistent distaste for biological detail. These feminist theories have usually been reluctant to engage with biological data: they retain, and encourage, the fierce antibiologism that marked the emergence of second wave feminism. That feminist scholars are particularly prone to a `knee jerk constructivism' helps explain the reluctance of those in the humanities to engage seriously with the claims of science. This book functions primarily as a reminder to social, political, and cultural theorists, particularly those interested in feminism, antiracism and questions of the politics of globalisation, that they have forgotten a crucial dimension of research, if not necessary to, then certainly useful for more incisively formulating the concepts on which they so heavily, if implicitly rely. It is written as a remembrance of what we have forgotten — not just the body, but that which makes it possible and which limits its actions: the precarious, accidental, contingent, expedient, striving, dynamic status of life in a messy, complicated, resistant, brute world of materiality, a world regulated by the exigencies, the forces, of space and time. We have forgotten the nature, the ontology, of the body, the conditions under which bodies are encultured, psychologized, given identity, historical location, and agency. This book examines the labour standards provisions in a number of Regional and Bilateral Trade Agreements, and assesses the potential of using the relevant clauses in these trade agreements as a benchmark for a multilateral approach. Based on the lessons learned from the Regional model, the book proposes a Global Labour and Trade Framework Agreement (GLTFA) combined with a joint ILO/WTO enforcement mechanism to resolve the contentious issue of the link between the CLS and international trade. The history (...) of the linkage between the Core Labour Standards (CLS) and international trade dates back roughly 150 years, and has recently become one of the most vexing issues facing policy-makers. At the heart of the debate is the question whether or not trade sanctions should be imposed on countries that do not respect the CLS as embodied in multilateral conventions administered by the International Labour Organization (ILO). Concretely, this would entail inserting a social clause in the World Trade Organization (WTO) rules, and would trigger the imposition of sanctions on those countries that do not adhere to the CLS. In recent years, there has been a wide-ranging debate about the neo-republican principle of non-domination. Neo-republicans argue that domination is a capacity for one to intentionally use arbitrary power to interfere in someone’s life. Critics of neo-republicanism argue that this definition of freedom as non-domination precludes a structural analysis of domination, which would explain and critique the ways in which societies produce structural domination unintentionally. The article focuses on capitalism’s labor process and its labor markets. It argues that critics are (...) correct to think that the neo-republican principle of non-domination has an insufficient scope, but that an alternative account of structural domination should still support the neo-republican idea that agency must be involved. Otherwise, we might simply fail to explain the social processes that reproduce structural domination. What is needed is to explain how the labor process creates incentives for agents to intentionally produce structures that have unintended, yet dominating effects, and in turn, how the intentions of agents are conditioned by their social positions. Since 1997, FORUM has been an integral part of the landscape of European studies. In addition to contemporary history, it offers insights into the history of ideas and reviews books on Central and Eastern European history. It offers more than just history--for instance, interdisciplinary discussions by political scientists, literary, legal, and economic scholars, and philosophers. FORUM sees itself as a bridge between East and West. Through the translation and publication of texts and contributions from Russian, Polish, (...) and Czech researchers, it offers the Western reader access to the scholarly discourse of Eastern Europe. The 'short' 20th century is one of the best-documented eras in history. Nevertheless, it holds more mysteries than many periods of antiquity or the Middle Ages of which we have only sparse relics. One of the biggest mysteries is the question of the causes of the collapse of civilization in the first half of the century. In Germany as well as in Russia, regimes came to power invoking the implementation of utopias that had been dreamt up during the 'long' 19th century yet which had been considered unrealizable. Now, it turned out, even the most radical utopian blueprint could be put into place. This development, intertwined with an extraordinarily deep crisis of European democracy, did not happen overnight. It had been looming for a long time. There had even been several prescient voices heralding the upcoming crisis--trailing away without being noticed. Volume 19, Issue 1 of FORUM recognizes some of these unheard prophets and scrutinizes their writings. (shrink)

This essay offers a new reading of Marx's chapter on ‘the working day’ in Capital Volume One by exploring the textual theme of night-time work. Even as Marx emphasises how the lengthening workday enables the super-exploitation of producers’ wage labour, his depictions of nocturnal experiences highlight more forcefully the destruction of workers’ reproductive resources, capacities and relationships. Night comes to represent the contracted time, condensed space, petrified relational bonds and thwarted desires for human reproduction in a free, fulsome sense (...) that includes reinvigorating oneself, caring for others and enjoying experiences apart from work or care. Night's role as a privileged signifier and catalyst of these changes comes through in key passages about women, children and vampires, and in theoretically meaningful variances between Marx's German paraphrasing of English sources and those original texts, which replace Marx's phrases in English translations of Capital. Contemplating Marx's ambivalent reflections on legal-political action to limit workday hours, I argue for making struggles over social reproduction in a capacious sense central to working-class politics today. I demonstrate the power of this Marxian analytic by considering the compression of social-reproductive time among today's microworkers, who fuel the digital economy by performing platform-based ‘tasks’ at all hours for very low wages. Alex Gourevitch’s From Slavery to the Cooperative Commonwealth is a valuable contribution to republican historiography: in reconstructing the ideas of the 19th century American labour republicans, this work significantly expands and enriches our appreciation of the classical republican tradition. While the labour republicans are convincingly shown to have made important contributions to that tradition, stronger claims that they fundamentally transformed republicanism are less persuasive.

This paper aims to take stock of the emerging international literature on the role of labor unions in corporate social responsibility (CSR). Where unions are discussed in the North American CSR literature at all, authors see them as foregrounding membership benefits over wider societal interests and hence contributing to systematic environmental degradation. In Europe, the managerialdiscretion of CSR clashes with the more regulated frameworks for employees and labor unions to influence corporate decision-making. Hence many European unions express a considerable (...) degree of skepticism of CSR. On the international scene, companies have become increasingly sensitive to how their labor management activities are perceived by the wider society, yet they may nevertheless continue with even highly controversial labor policies if they do not see a business case for changing these. In other words, CSR commitments by themselves would not seem to be sufficiently powerful to bring about systematic change in the management of labor. (shrink)

Digital technology can facilitate collaboration and data sharing among humanities scholars, and therefore is sometimes seen as a catalyst for attempts to revise problematic canonical traditions in literary history. In this paper, I interrogate how specific ways of organising scholarly labour make possible certain forms of knowledge, and I study the obstacles scholars face when trying to adapt established organisational models. For this purpose I draw on fieldwork in a large European database project, launched to create empirical knowledge (...) about “forgotten” women writers. Literary studies is characterised by monograph-oriented scholarship, situated in regional disciplinary contexts. The collaborative use of a database, however, requires an integration of individual research practices, and it blurs the division of labour between scholars and information professionals. France’s agreements on the joint management of migration flows figure centrally within studies of bilateral migration agreements. With their origins in friendship and navigation treaties of the late 19th century, the AJMs are successors to the postcolonial, circular mobility conventions of the 1960s, and are uniquely positioned for periodizing the evolution of bilaterally negotiated labor mobilities. Nonetheless, due to the European Union’s reluctance to embrace mass regularization and the EU Member States’ legislative powers over labor markets, they have time (...) and again scotched France’s ambition to leverage preferential labor market entries in exchange for more cooperation over irregular migration. Through documents and statistical data analysis, this Article studies the case of Senegal’s negotiation of additional pathways to France for its lower-skilled workers. At the center is France’s administrative court of appeals, which has confirmed the broad margin of discretion over Art. 42 in the AJM between France and Senegal. This jurisprudence has decoupled the automatic linkage between a job listed under duress in France under the Annex to the AJM and the entitlement to exceptional admission. We argue that France’s courts have removed a privilege of Senegalese workers, which has re-politicized France’s migration diplomacy with Senegal. At the same time, retention of the prefectorial discretionary power has levelled the playing field among West and North African countries that have concluded similar bilateral agreements with France. This Article adds to the research on bilateral migration agreements by proposing a multilevel legal analysis, which studies AJMs in the context of France’s common law, EU labor and return directives, and the multilateral of WTO/gats liberalization. Business Ethics: A European Review, EarlyView.

The labor market is an area with diverse data structures and multiple applications, such as matching job seekers with the right training or job. For this reason, the multilingual classification of European Skills, Competences, Qualifications and Occupations (ESCO) is a good example of the central role of ontologies in this area. However, ESCO cannot provide all the details of local labor market needs and does not provide links to other hierarchies of competences. For example, other taxonomies of occupations and (...) skills are widely used in German-speaking countries, but they are not in a state where they are easily accessible for interoperability and reasoning. In this paper, we present a first version of a German Labor Market Ontology (GLMO) that uses ESCO as a top-level ontology for the target domain. This makes it highly interoperable and comparable to existing ontologies by providing details for the regional structures in German-speaking countries. In addition, we present a detailed evaluation of the provided data and applications, as well as an extensive discussion of future work. (shrink)

The intent of this work is bring to attention, as useful elements for a debate, the possibility of reasoning on the implementations that will come to the country-system from the resources of the PNRR. From a historical, albeit brief, and legislative analysis of active labor policies in Italy, one can try to understand how to stimulate Italian economic growth. To do this, one must examine the structural elements that contribute to making our country fragile in comparison with other European (...) countries, fragility associated with the horizontal and vertical segregation that characterizes the world of work. This is a phenomenon that has worsened further during the pandemic crisis. Hence, employment discontinuity, non-standard contractual forms, differences in male and female employment rates, as well as that set of social, cultural, and psychological barriers all become elements that decline the concept of horizontal and vertical segregation mentioned earlier. This is where the PNRR comes into play, whose intentions include promoting a process of transformation in tune with the great changes in the socio-economic scenario. (shrink)
